The multi-purpose Proof of Service, form POS-040, for service on opposing counsel by mail, fax, e-service, etc. will be changed, striking the words “not a party to the action”. A review of the statutes governing service does not limit a party from serving these documents, so the form proof of service is inaccurate. This language is also being eliminated from the Proof of Electronic Service, POS-050/EFS-050.
Proof of Service of Summons form (FL-115) will be revised, eliminating reference to the non-existing capacity notice on the Family Law Summons, and to some revoked forms relating to dissolution of marriage and domestic partners. There will be revisions to the Family Law Petition, FL-100; Summons, FL-110; Notice and Acknowledgement of Receipt, FL-117; and Response, FL-120.
